Terms and Conditions

These terms and conditions are for clients wanting wedding photographs. Please take time to read through them.
Booking fee: The booking fee of £50 secures the date, time and services of Memorys for your wedding and is non-refundable or transferable in the event of cancellation, it being the agreed loss suffered by the photographer/s due to cancellation.
Cancellation less than 10 weeks before the wedding date will result in payment in full. All cancellations must be put in writing.

Payments and prices: Following payment of the £50 booking fee, balance of full payment is due 28 days prior to the wedding date. No photographs or wedding albums will be delivered until all payments due have been paid in full.
At the time of ordering your wedding album/s you have on the day of viewing your images and 7 days after to confirm your order on the amount of albums you require. After this time all offers, discounts and prices will be made void and unavailable.

Attendance: In the unlikely event of the assigned photographer/s being unable to attend your wedding due to unforeseen circumstances, we reserve the right to appoint another photographer/s to attend your wedding on our behalf to undertake the wedding photography to his/her ability.

Copyright: Any images or copies of images whether stored digitally or otherwise and any computer programme including any source or object code, computer files or printed documentation relating to such images are protected by the Copyright and Design Act 1988 and remain the copyright of Memorys. It is contrary to the Act to copy or allow to be copied photographically, electronically or by any other means an image created as part of this contract without written permission of Memorys.

Display: By signing the consent form the clients hereby allow the photographer/s to display any images and to generally promote the business by means of advertising, publicity material, websites, exhibitions, competitions, magazine articles and other such media, providing that the images are used lawfully and without damage to the clients. Images placed in password protected galleries within the website are not available to the general public in the normal course of events. However it may not always be possible to prevent determined persons from accessing these galleries.

Data Protection Act 1998: The photographs which you have agreed to be used on the consent form will be used solely for the purpose of promoting the activities of Memorys and will be held without limit or time. When you purchase our services, you also request to us that you have provided notice to and obtained consent from any third party individuals whose personal data you supply to us with regard to (1) the purpose for which such third party’s personal data have been collected (2) the intended recipients or categories of recipients of the third party’s personal data are obligatory and which data, if any, are voluntary and (4) how the third party can access and if necessary rectify the data held about them. In addition to the privacy protections that we provide, our employees, agents and business partners are independently responsible for ensuring compliance. You are protected by uk law under the Data Protection Act. This act can be found at www.dataprotection.gov.uk. Personal data supplied to the photographer/s may be stored for future use. This data will only be used to inform you of future opportunities and to be kept up to date and will only be held as long as is necessary. The photographer/s will take all necessary steps to ensure the information is held and used in accordance with the above act. Memorys will not publish personal details of any individual alongside any image in our printed material or on the website. However, we do not accept responsibility if you are recognised from the image by members of the public.

Negative/Digital files: Negative and digital files remain the sole property of Memorys.

Image Reproduction: Owing to photochromatic anomalies caused by a combination of certain dyes and materials, especially in man-made fibres, it is sometimes impossible to record on camera the exact colour of materials as perceived by the human eye. When processing images, the photographers will endeavour to achieve a pleasing overall colour balance based on natural flesh tones.
Due to the limitations of computer monitors it is understood that images may appear differently according to the specification of each monitor and that prints will not match images rendered on any particular computer monitor.
Where images are made available for use with a personal computer the default operating system shall be Windows Vista basic. Products may not function on other operating systems.
We use only quality branded CDs, ensuring each is checked before dispatch, but it remains the responsibility of the clients to check discs for in-transit damage. The photographers cannot be held responsible for damage to equipment resulting from defective media

Licence: The photographer will be granted artistic licence in relation to the poses photographed and the locations used. The photographer/s judgement regarding the location/poses and number of images shall be deemed correct. Due to the unpredictability of the weather and the willingness of subjects it may be impossible to capture all of the images requested. For weddings involving a church ceremony or at certain other venues photographer/s movement are sometimes restricted by the minister or official in charge. Photographing of parts or even all of the ceremony may be restricted or prohibited as may the use of artificial lighting. The photographer/s cannot accept responsibility for limited coverage in such cases. Due to a variety of lighting conditions and the limitations of digital sensors, some colours may alter throughout a set of photographs. Photographs taken during the course of your wedding will be at the discretion of the photographer/s although every effort will be made to comply with the clients requirements. The photographer/s shall endeavour to photograph all individuals as requested by the clients at some point during your wedding day but no responsibility will be taken by the photographer/s in the event of leaving someone out. On your wedding day the photographer/s shall endeavour to capture all moments throughout the day as they occur. However, because of the nature of the event as a one off, some unforeseen moments might not be recorded. Please note that any alterations made to your wedding day i.e. venues, times, etc Memorys must be informed immediately in writing of the changes made. Memorys will do their very best to accommodate the changes made to your wedding day. However this does not include the change of your wedding date due to a conflict of commitments. Under these circumstances Memorys are not liable to compensate the clients in anyway whatsoever. It is understood that all photographic printing is undertaken within the technical limitations of the process and that colour may not necessarily be facsimile over the whole range of colours within a subject. It is also understood that prints made at different times or in different sizes may be variable in colour balance. All print and presentation size quoted are approximate and subject to the discretion of the photographer/s. Although all equipment is checked regularly the photographer/s will not be responsible for photographs that are not produced due to technical failure, either at the shooting or processing stage.

Force majeure or Act of God: The due performance of this contract is subject to alteration or cancellation by either party owing to any cause beyond their control.

Cancellation: The client may cancel their wedding photography at anytime by giving written notice to Memorys but in doing so shall forefeit any monies paid. Cancellation less than 10 weeks before the wedding date will result in the payment in full.

Complaints: In the unlikely event of any complaint with regards to our service, all complaints must be received in writing within 7 days of collection of products purchased. This includes photographs, albums and frames.

Insurance: The clients are hereby advised to take out an insurance policy to cover any expenses in the event of cancellation.

The photographer/s reserves the right to amend these Terms and Conditions without prior notice
